Albany Bankruptcy Lawyer

Thorough, individualized service from attentive New York attorneys

In these uncertain economic times, it’s easy to find a Saratoga County attorney who will process your bankruptcy. It’s a bit harder to find one who will take the time to thoroughly analyze your financial situation and give you sound advice based on many years of experience. At Jean M. Mahserjian, Esq., P.C., we believe that while bankruptcy may be the best option for many individuals, it is not something to rush into. We help our clients make informed decisions, with a full understanding of the costs and benefits. If you’ve been bombarded by advertisements from bankruptcy lawyers, but still feel confused and anxious about the process, Jean M. Mahserjian, Esq., P.C. can help. We represent individuals in consumer bankruptcy proceedings under Chapter 7 and Chapter 13.

Chapter 7 bankruptcy — Individuals whose income is below the median for their sized household can file for bankruptcy under Chapter 7. A bankruptcy trustee will be appointed, who will inventory assets, set aside New York State exempted property, then sell off the bulk of the assets. Debts that are not satisfied by the sell-off will be discharged. The debtor then has a clean slate, though his credit has been damaged and will take years to repair.

Chapter 13 bankruptcy — Rather than discharging debt, Chapter 13 reorganizes debt, proffering a repayment plan that the debtor promises to complete, usually over a three- to five-year period. Chapter 13 protects assets that would have to be liquidated under Chapter 7. It is often a good tool for homeowners whose equity exceeds their New York State property exemptions. For more information, see our Chapter 13 bankruptcy page.
