I want to file for an uncontested divorce, please. I was married December 2013. I had NO Idea this man was unstable. He was released from prison April 2015. I have been separated since July 2016 and August 2016 from The Narcissistic Abuser, bully who has threatened me (different threats). He is extremely emotionally unstable. He has made physical threats along with threats to ruin my education.
He is dishonest and a danger to me and my daughter. He is a convicted felon who suffers from anosognosia. He has cost me to lose everything, I had which wasn’t much to begin with. He has intimidated my daughter. He would go into her bedroom when we weren’t present. He would “side eye” her when she walked by looking at her backside inappropriately. Last but not least, I am a 3L law student in the 4 year program, attending Western New England University School of Law. I do not want my spouse’s last name attached my Juris Doctor Degree in 2019.

Answer:

An action for divorce is filed in Supreme Court in Albany. However, it is only uncontested if both parties agree on all issues that need to be resolved. If you are graduating in 2019 and want your name back, I would recommend that you file promptly to ensure that you can obtain a divorce before you finish school.
