Will my ex-spouse be required to switch health insurance after a divorce?
Answer:
The domestic relations law requires that your ex-spouse, or soon-to-be ex-spouse, be notified of the possible loss of health insurance. Simply put, it’s a notice that she gets served with, along with the summons and complaint, that basically says that she would no longer be eligible for health insurance coverage at the time of the divorce. She would be served with that notice at the outset of the case. If you’ve entered into an agreement, or even at the time of the judgment of divorce, she would likely be receiving another notice. If those things have occurred, then you’ve fulfilled your obligation and there’s no concern; she can be removed from the health insurance as of the time of the divorce. If not, the court may then just offer her more time to obtain her own health insurance.
