Obtaining a Child Support Order in New York State

shutterstock_180100655Child Support Orders in New York State are issued by either Family Court or Supreme Court. If you are apartied to an action for Divorce, then the order will be issued by Supreme Court. Family Court is one of limited jurisdiction, and it cannot address a Child Support case if Supreme Court is handling the Divorce case. However, if you are not apartied to a Divorce action and you are not negotiating a separation or opting out agreement, you can file for Child Support in Family Court. in Family Court, the support magistracy will hear that case, if necessary, and will issue an order of Child Support.
