New York’s equitable distribution laws complicate the division and allocation of property in high net worth divorces. Equitable does not necessarily mean equally. The court’s decisions are based on what each spouse contributed to the marriage and what they need after the divorce. While it may have many of the same provisions as the pre-nuptial, the post-nuptial can be harder to enforce. The court can question any child custody arrangements outlined in either agreement.
