Jean M. Mahserjian, Esq., P.C. has provided no-fault divorce representation since New York adopted the practice in 2010. Prior to 2010, a divorcing spouse needed to allege and prove grounds, such as cruel and inhuman treatment, constructive abandonment, adultery, etc, before being able to obtain a divorce. In 2010, No Fault was enacted whereby a divorcing spouse no longer has to allege such grounds, but can obtain a divorce upon the irretrievable breakdown of the marriage for at least 6 months. The focus then becomes how to resolve the economic issues of the marriage, including division of assets and liabilities, spousal maintenance, child custody and child support.
