As a Saratoga Divorce Attorney I often have clients come to me asking if they win their personal injury settlement, if it will be considered joint marital property.  In the state of New York, an injury settlement a separate asset and not required to be part of equitable distribution.  I always advise clients as a Saratoga Divorce Attorney that if they do win a settlement, not to put the money into a joint account because then it will be considered marital property.
