What should I do when mediation doesn’t work?
Answer:
If your mediation breaks down, you are then going to need to have your divorce attorney either negotiate or litigate the issues that remain in your case. Because the requests for mediation have increased so much over the past several years, we are sending a broader array of cases to mediation, and sometimes our clients have difficulty concluding their issues in mediation. That doesn’t mean that the process was a waste of time. It simply means that not every issue could be finished in mediation. It usually remains beneficial that the parties started in mediation. We are then able to conclude the balance of the issues, either through negotiation with divorce attorneys or through litigation with a judge assisting us in concluding the issues.
