New York courts will recognize an out-of-state marriage in granting a judgment of divorce. However, there are residency requirements. I advise clients as a Saratoga Divorce Attorney that the first is if you are residing in New York State as spouses that you have resided here for a continuous period of one year preceding the action. Otherwise, if one of you lives in the state, it would be required that you have resided here for a period of at least two years immediately preceding the commencement of the action for a divorce.
