You can file a paternity petition prior to the birth of your child or he can acknowledge paternity at birth, at the hospital. I would recommend that you consult with a local Albany Child Custody Attorney to determine your right to child support. Without a court order, you have no guarantee that he will, indeed, “help”. And, “helping” is not the point. You both will now have a child and he has an obligation to provide consistent support based on his income. I would also recommend that you formalize any agreement that you enter into regarding custody and parenting time.
