How Can I Change My Child’s Last Name?

Saratoga Family Law AttorneyAs a dedicated Saratoga Family Law Attorney, I am often asked how to change a child’s name to match a parent’s.  If you want to change your child’s name to match yours, you will first file a petition in the Supreme Court – rather than the family court – and serve the other parent with notice of your petition. You should be aware, however, that the court will not grant a petition to change a child’s name if the other parent is alive, can be found, and objects to the proposed name change – even if it is requested for a very good-hearted reason such as to match your own. If the other parent objects, the court will simply not grant the petition.
