Question:

How can I prove my ex-spouse has imputed their income?

Answer:

Proving Imputed IncomeIf you believe that a party is voluntarily unemployed or underemployed, you can investigate to try to impute income to that person. There are several different ways that you can go about it and several different types of evidence that the court can consider. First, the court can consider one party’s historic income – what do their prior employment or their prior work records show as their income? What was the family’s lifestyle? You can have a forensic accounting done to show what was spent, or what was received, and what is actually being reflected on paper.

There are also specific experts to someone’s given field of employment that could be called upon to analyze or testify about standard incomes or wages in a given field, and even experts that can testify as to employability in anticipated wages.
