Saratoga Child Custody Lawyer Explains if You Will Lose Custody of Your Child by Moving

Saratoga Family Law AttorneyQuestion:

I am a mother to a 4-year-old, she has always lived with me and my mother. I recently got married to someone, who’s in the military. I am in the process of moving, but the school system requires my ex spouse to write a letter stating that he knows she will be attending the new school. I never told him that I got remarried because he doesn’t want me to move on, or have my daughter if I do. What should I do? Will I lose my daughter because I am married to someone else?

Answer:

It looks like you have a relocation case here. The court is going to look at the best interest of the child, as well as several other factors. Every case is different so the factors can vary. Typically the Court will look at the reason you want to move, dad’s relationship with your daughter, positive and negative impacts of the move on your daughter, and much much more…

As an experienced Saratoga Child Custody Attorney, I encourage you to contact a lawyer immediately to address these issues and to ensure that you are protected.
