What is the purpose of a legal separation agreement in New York State? Can I use it if we are still living together?  I would like to consider a legal separation from my husband while we are still considered divorce.

Answer:

I am often asked as an experienced Saratoga Divorce Lawyer about seperation agreements.  If you wish to be legally separated, but remain living under the same roof, your separation agreement will need to address that issue. A legal separation agreement allows you to separate your assets and debts, and address issues such as custody, child support and spousal maintenance. I advise my clients as an experienced Saratoga Divorce Lawyer that once you have a legal separation agreement, that agreement can form the basis for a divorce, if you decide to divorce at a later date.
