I understand they do not have to leave and you have no legal way to remove them. If we sign a separation agreement and she moves out and the living arrangements don’t work out, does she have any legal rights to return?

Answer:

That will depend on what your separation agreement says about who lives where. Are you staying in a home that the two of you own? Will you be buying her out and/or will she be retaining other assets in lieu of her share of the home?
