The Divorce Mediation Process

mediation estate planningI usually describe Divorce Mediation in New York as forward-looking and solution-setting, whereas Divorce Litigation is backwards-looking. There are numerous mediators in New York State, and they can assist you in obtaining a less contentious Divorce that you can obtain through the Litigation process. It is advisable that you speak with an Attorney at an early point in the process. The reason for that is because the Mediator does not represent either party in the process.

In my opinion, it is impossible for one mediator to sit with two spouses, and give each of them the full range of legal advice that they need to have before they consider Mediation options. That being said, you do not need to spend substantial sums on legal assistance when going through Mediation. You will need an Attorney at the conclusion of the Mediation process because your paperwork has to be prepared.
