The Grounds for Divorce Process in New York State

The Grounds for Divorce is the basis for the granting of the actual Divorce, and those Grounds are contained in New York statutes. Historically, we only had Fault-Based Divorce in New York, but we now have No Fault Divorce.

The Fault basis for Divorce includes abandonment, cruel and inhuman treatment, and adultery. The No Fault basis simply requires the sworn statement of one spouse that the marriage has irretrievably broken down for a period of 6 months or longer. Fault Grounds for Divorce often provided a significant area for disagreement and litigation in Divorce cases. In many instances, that basis for argument, litigation, and disagreement has abraded in New York. Most litigants and most Attorneys now choose to file for Divorce on a No Fault basis.
