Waiting on a Divorce DecreeQuestion:

I am currently waiting on the judge to sign the divorce decree, my question is how will I know when that has been done, since I do not have a lawyer and he does, will I be notified that the divorce decree has been sign by the judge. Will I need to go back to court to sign it aswell. Also those was a stipulation put in place, $500 monthly for the next 10months that should have started 3/1/17 However it’s now 4/10 And I have not seen a penny. I cannot afford to take off work again for court especially given the factor that it’s a new job. What can I do. I am hoping that I need to go back to court for the decree so that I can bring this matter up, it please someone advise me.

Attorney Answer:

The Court should send you a copy of the signed Divorce Decree. The timing varies. If you do not receive a signed decree within a month or so, I would call the Court to request a status update. If your stipulation states that funds should be paid on a monthly basis as of 3/1/17 and they have not been paid, you can file a Violation Petition. You would file that after you receive your signed Divorce Decree from the Court. Filing a Violation Petition will require you to appear in Court.

Also i am to live out of the house 2/28 and to take all my furniture, I moved out on time, however due to financial concern and health matters I was unable to remove all my furniture his lawyer emailed me on 3/14 advising me that I have 30 days to remove the furniture we agreed via email for me to do so on 3/18… I showed up come find that he removed my furniture and placed them in the garage however he held on to few of my furniture inside his house, I ended up calling the police for the items in that was still left inside his house, however gotten no where. I removed few items and express to him that we be back for the rest, upon returning back within half hour my driver and brother knocked(to let him know we are back in his property) no reply end up calling the cops again they knocked and the same thing… what can I do?

Have you contacted his attorney? Since you are not represented you can do that. Advise that you went there at the agreed upon time/date and let him know what happened. If you property was to be removed by 2/28 per your Agreement, you may have a hard time getting it.
