As an experienced Saratoga Family Law Attorney, I know there are certain conditions that have to be met in order to obtain a divorce in New York. You must meet a residency requirement at the time you commence your action for divorce. Additionally, to obtain a divorce pursuant to “No Fault,” you must demonstrate that the marriage has broken down irretrievably for a period of at least six months. Based upon what you have described; you have not yet met those two requirements.
