Can I change the terms of a divorce agreement after it has been finalized?

Answer:

Changing a Divorce AgreementIt is not uncommon for parties to seek to change the terms of a divorce judgment after the divorce has been finalized. When this is being done consensually, we have several ways of implementing those changes. If the issue is a custody issue or a support issue, we can usually prepare a stipulation that will be submitted to family court, and then it gets filed with a petition for modification and draft order, and we ask the court to simply execute the order based upon the stipulation. This can be done without court appearances in most instances.

 
If it’s a property issue, what we generally will do is an addendum to the agreement and then an amended judgment of divorce. We occasionally have an issue with the judge accepting an amended judgment of divorce, but in most instances, we are able to affect the change with that procedure.
