Answer:
You would first need to ensure that the jurisdictional requirements for a divorce in New York State have been met. Then, you commence an Action by purchasing an Index Number filing a Summons alleging your ground for divorce (your reason for divorce, as outlined by N.Y. Domestic Relations Law section 170).
There are many factors to consider when considering a divorce, and it is always advisable to consult with an experienced matrimonial attorney. Filing for divorce involves a lot of paperwork. An attorney can not only guide you through the process and prepare all of the necessary forms, but also inform you of the risks and benefits (such as the possibility of being liable for alimony payments and/or legal fees to your spouse, and restrictions on transferring assets during a divorce proceeding).
If, however, you want to proceed with a divorce without an attorney, the NY State Unified Court System offers free instruction booklets and divorce forms on their website here: https://www.nycourts.gov/divorce/forms.shtml
