We have been trying to finalize divorce for 2 years now. Both lawyers met with Judge yesterday without my ex and I for a conference. As usual, no conclusion was reached. We have 3 children. I am asking to claim at least 1 child per year, and my ex refuses. I am also looking to get an additional evening with the children every other week to even out our joint custody schedule. My ex refuses. I’m only asking those 2 items. My lawyer sent a memo to me yesterday after their conference asking for $5,000 to prepare for trial. I do not have this. After $13,000 dollars spent on this lawyer, I now have to give in.

You can only attend the pretrial conference if you discharge your Saratoga Divorce Lawyer and represent yourself. As you have realized, if you and your spouse do not agree on all of the issues, you cannot finalize your divorce. That means that you will have to have a trial and the Judge will make a decision on those issues. While your trial may cost $5,000 or more, what is the value to you of the dependency exemption? Did the Judge indicate to you that he/she would grant you that dependent? If yes, the cost of your trial may be worth it.
