My ex-Boyfriend has a child support agreement in Colorado for his 3 kids. We moved, together with our daughter to Albany and now we are broken up for good.
He already has an agreement in Colorado, which he hasn’t been paying at all and has a suspended license. He hasn’t transferred his case to NY.

Because he has a case in another state, does OUR daughter get less money bc he has other obligations? Or because I’m filing in NY will they focus on our daughter first? How does this work?
Will my kid get less because of the other kids? Or is it equal?
Since I’m filing against him in a new state, won’t my daughter get ‘dibs’ first then his ex have to have her support case sent to NY?

Answer:

I am assuming that the Colorado support obligation is based on an order and that is why his license is suspended. That prior order will be considered by the NY Court when determining his support obligation to your child.  As an experienced Albany Child Support Attorney I do not know the percentages in Colorado. However, in NY it would be 29% for three children. He also has income tax obligations. You will have to fight for every penny. And, if he is not paying the Colorado obligation even at the cost of having his license suspended, you know what you will be confronting him over time to collect support for your daughter. Make sure your support order goes through the Support Collection Unit. They will provide some assistance in pursuing him over time.
