My divorce and child custody agreement was handled in Saratoga County, NY. My ex has primary physical custody of our son; we have joint legal custody, including equal say for all educational decisions. The custody agreement also says that my residence determines his school district.

My son has special needs and is being removed from public schools. We are currently working with the school district to find an outplacement program/school that is a better for his needs.

Unfortunately, from what you have conveyed, it does not appear that this issue can be easily resolved per your custody agreement. As an experienced Saratoga Child Custody Lawyer, I would recommend that you continue to work with the school to see what they recommend. If there are a number of options suggested by the school, and none of them are the district where you reside, you will either need to come to an agreement with your ex or ask a court to resolve this issue.
