Saratoga Child Support Attorney Discusses Add-On Expenses

Question:

If a stipulated child support agreement will include pro-rata sharing of unreimbursed children’s medical expenses, is mileage to/from doctor considered an unreimbursed medical expense? Using, for example, federal rates as noted in IRA instructions. the monied spouse says “no”; the custodial parent thinks “yes”. The agreement is still under negotiation. If so, would the Agreement have to be explicit, or is this a “given”?

I have been closely asked the same question before as a Saratoga Child Support Attorney and the short answer is no. Unreimbursed medical expenses include copays and prescription costs. Basic child support covers other expenses for the child – such as housing, clothing, transportation, etc. I will advise clients as a Saratoga Child Support Attorney that if you can get your spouse to agree to pay that and it is explicit in the agreement, then you would be entitled to reimbursement.
