The father has a court order stating he can have supervised visits.  The mother has stopped caring for the daughter, and cares more about her job and boyfriend.  As a result, the daughter is now staying with the Father.  What will the court do if I reveal what’s been happening in an effort to gain custody rights for my daughter?

As an experienced Saratoga Family Law Attorney, I would not advise under any circumstances to violate an Order of Protection, or an Order of the Court. Regardless of the Mother’s motivation or own bad behaviors, your violation of a court Order could have very negative consequences for you personally.

If there has been a significant change of circumstances (i.e. mom left the child alone with you and has been absent/unstable), I suggest that you consult with an experienced local attorney. It might be advisable file a Petition to Modify Custody with your local family court to lift/amend the terms of your existing Order.
