Saratoga Family Law Attorney on Obtaining Evidence to Get Full Child Custody

I believe my son’s mother is letting a sex offender around my child, do I have enough evidence to go for full custody? Im worried

Details- never married- my son is 6, not been together since 1st birthday. I only introduced my son to one person and that’s my now wife (she came into his life on 2nd birthday). My sons mother has been with numerous partners (10+) and introduces them all to my son and moves around.
We agreed on paper 50/50 a month ago, She did have primary, but is ‘very busy’ so I have him more.

Anyways. She tells me she is seeing someone and needs my permission to see him? I go to pick up my son,and she says that the person she is seeing, was 18 and slept with a minor..she’s saying he was 18- the girl was 17…… so he’s a sex offender? Or what?
She wants me to call the probation officer and tell them it’s okay for that man to live with my child…. I can’t get ahold of the officer, I want to get the truth. I have in our text messages the probation officers name, this new guys name, and that he has ALREADY been around my child…
I was so blindsided by this. I’m angry and need advice. She just ended a relationship two weeks ago, now she wants this guy to move in?!
My son- says that he ALREADY lives there… and that he sleeps there at night sometimes!

As an experienced Family Law Attorney, I often handle situations like these.  I would strongly recommend that you consult with a local attorney ASAP and get into Family Court promptly. You can and should ask for primary custody and you can tell her and the probation office that it is not ok for this guy to live with or be with your son. You do need to get all of the information that you can on this guy – as quickly as possible. Check the sex offender registries online to see what you can find out.
