Saratoga Child Support Lawyer Discusses Calculation of Health Insurance

I am often asked as an experienced Saratoga Child Support Lawyer how health insurance is calculated between two parties for their child’s health insurance.  In New York State, health insurance for the children is a part of the Child Support Standards Act. It is not paid as a part of the basic percentage payment that the non-custodial parent pays to the custodial parent. I tell clients as a Saratoga Child Support Lawyer I advise clients that either party may carry the health insurance for the children. The payment made directly for the health insurance is made by the party that carries the insurance, but the other parent will then pay a portion of that premium back to that parent by what ever basis they decide. The parents pay health insurance in proportion to their income. For example, if each parent earns $50,000 per year, their payments of the health insurance would each be 50 percent. If one parent earns $100,000 and the other parent earns $50,000, the parent earning $100,000 would pay two-thirds of the health insurance premium.
